1. Acceptance of Terms

Welcome to HelioVideo ("we," "our," or "us"). By accessing or using our website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you do not have permission to access the Service.

2. Description of Service

HelioVideo is an AI-powered video generation platform that allows users to create video content from text, images, and other inputs. We strive to provide high-quality services but do not guarantee that generated videos will always meet your exact expectations.

AI Model Disclosure: HelioVideo is an independent product built on top of underlying AI models. Model names such as Sora 2, Veo 3.1, Wan 2.6, and Seedance referenced in our marketing and feature descriptions are used solely to identify the technical capabilities we provide through a custom interface. HelioVideo is not affiliated with, sponsored by, or officially endorsed by OpenAI, Google, Google DeepMind, Bytedance, or any other model publisher. All model trademarks remain the property of their respective owners.

3. User Accounts

To access certain features, you may need to register for an account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must provide accurate and complete information.

4. Acceptable Use Policy

You agree not to use the Service for any of the following. Violations will result in immediate account suspension or termination with no refund of fees paid:

  • Sexual or adult content: Generating any pornographic, sexually suggestive, nude, NSFW, or adult-oriented content. This includes real-person, anime, illustrated, and AI-generated content of any form.
  • Content involving minors: Generating any sexualized, violent, or exploitative content involving minors. Such content will be immediately reported to the appropriate law-enforcement authorities.
  • Face-swap and deepfake: Generating face-swap, deepfake, or face-manipulation content of any real person without that person's explicit written consent.
  • Infringing content: Generating content that infringes any person's copyright, trademark, likeness, or other intellectual-property rights.
  • Illegal or harmful content: Generating content that is illegal, threatening, abusive, harassing, defamatory, hate-speech, incites violence, or is otherwise objectionable.
  • Misinformation and fraud: Generating content intended to mislead, defraud, or impersonate, including fake news, forged identities, or impersonation of government officials.
  • Service abuse: Interfering with Service integrity, attempting unauthorized access, reverse engineering, scraping, or bypassing credit/rate-limit mechanisms.
  • Resale and redistribution: Using the Service's API, credits, or generated output for resale to third parties without authorization.

We may use automated content-moderation tools (including the Moderation API required by our payment processor, Creem) to screen user prompts. Any request triggering the prohibitions above will be rejected, and associated credits are non-refundable.

5. Intellectual Property

Subject to these Terms, you retain ownership of the content you upload to the platform. For video content generated using the platform, we grant you the right to use, reproduce, and distribute such content, provided you comply with these Terms.

6. Credits and Payments

Certain features of the Service require credits. Credits can be obtained through purchase or subscription. All prices are listed in U.S. Dollars (USD) and processed through our third-party payment provider. We reserve the right to change our prices and billing methods at any time; any such changes will apply only to orders placed after the change takes effect.

7. Refund Policy

We are committed to fair refund handling within reasonable limits. Full rules are described in our Refund Policy. Summary:

  • System errors: If a video fails to generate due to an issue on our side, the corresponding credits are automatically refunded to your account.
  • Subscriptions: Within 7 days of your first subscription charge, you may request a refund if you are unsatisfied and have not consumed a substantial portion of your credits.
  • One-time credit packs: Refundable within 7 days of purchase provided the credits have not been used. Consumed credits are non-refundable.

8. Subscription Cancellation

You may cancel your subscription at any time from your account's Billing / Subscription settings, or by contacting [email protected]. Upon cancellation, your subscription will stop auto-renewing at the end of the current billing period; you retain access to the service and remaining credits for that period. Expired subscription credits are handled according to our credit-expiration policy.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved in good faith through informal negotiation.

10. Dispute Resolution

If negotiation does not resolve a dispute within 30 days, both parties agree to submit the dispute to the courts of competent jurisdiction located in the State of Delaware. To the extent permitted by applicable law, both parties waive the right to participate in a class action against the Service. Consumers in the European Union retain the mandatory consumer rights granted by the laws of their country of residence, which are not affected by these Terms.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, HelioVideo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Modified terms will become effective upon posting to the website. Your continued use of the Service after changes constitutes your acceptance of the modified Terms.
